Subtitle 11.2 Investigation by Independent Agencies

This Subtitle details the laws in relation to investigations by independent government agencies that are not the police. It focuses on the procedures of the various organisations and the powers they have to achieve their goals. This includes agencies, such as the Australian Securities and Investments Commission and the Independent Commission Against Corruption. This update includes new material and coverage on the powers and investigative capacity of the Australian Security Intelligence Organisation (ASIO). This is a timely addition to the material in light of recent government reviews of the powers granted to ASIO following the terrorist attacks on New York on 11 September 2001.
Together with Subtitles 2.8 "Royal Commissions and Commissions of Inquiry" and 11.1 “Investigating Crime”, this Subtitle will also be published as a stand-alone book Investigating Crime – The Laws of Australia.
Subtitle 14.4 Development Control

This Subtitle provides a comprehensive coverage of the planning laws concerning processes of development control in all of the States and Territories, except New South Wales. The update provides up-to-date coverage of the substantial changes made to the planning laws in a number of jurisdictions. This includes discussion of the Planning and Development Act 2007 (ACT), the Sustainable Planning Act 2009 (Qld), the Planning and Development Act 2005 (WA), the Swan and Canning Rivers Management Act 2006 (WA), the Hope Valley-Wattleup Redevelopment Act 2000 (WA), and the Metropolitan Redevelopment Authority Act 2011 (WA). The update includes a review of new subordinate legislation, such as the Development Regulations 2008 (SA). The New South Wales planning system has not been included in this update, due to the likely passage of the planning laws in late 2013 or early 2014.

This Subtitle outlines the statutory and common law rules relating to ships including registration and licencing, maritime liens, collisions and groundings, the limitation of liability for damage in various circumstances, towage, pilotage, wreck and prize. The update also covers several recent updates to shipping legislation such as the Navigation Act 2012 (Cth), the Shipping Registration Amendment (Australian International Shipping Register) Act 2012 (Cth) and the Personal Property Securities Act 2009 (Cth). Several updated references to amended international conventions to which Australia is a party are also discussed.
