New suite of content on surveillance device laws

Practical Law Commercial, with assistance from Special Counsel, Ooma Khurana and her team at Maddocks, has released four new resources on surveillance device and workplace surveillance laws in Australia. These new resources are also available to Practical Law Employment subscribers.

These time-saving new resources will assist subscribers in navigating the complex regulatory regime which applies to the installation and use of surveillance devices, including in relation to their use in the workplace:

  • Practice note, Surveillance device laws and workplace surveillance. This note provides an overview of the regulatory framework relevant to the use of surveillance devices in Australia, both generally and in the context of the workplace. It covers the various state and territory surveillance laws regulating the use of certain types of surveillance devices, including listening and audio, optical and visual, data, tracking or location, biometric and other types of surveillance devices. It highlights the key features of the laws, including compliance and enforcement. It also considers the potential application of other relevant laws such as the Privacy Act 1988 (Cth) and the Australian Privacy Principles and key criminal laws which may apply in relation to the use, installation and maintenance of surveillance devices.
  • Checklist, Key offences and penalties under surveillance device laws. This checklist includes tables setting out the key offences and penalties under state and territory surveillance device laws in Australia including in relation to the prohibited installation and use of surveillance devices; the use, communication or publication of information obtained using surveillance devices and the unlawful manufacture, supply or advertising of surveillance devices.
  • Checklist, Key offences and penalties under workplace surveillance laws. This checklist includes tables setting out the key offences and penalties under state and territory workplace surveillance laws including in relation to prohibited workplace surveillance; the use, communication or publication of information obtained using surveillance devices in the workplace and other key workplace surveillance offences and penalties.
  • Checklist, Practical considerations when introducing and using surveillance devices. This checklist provides an overview of key legal and commercial issues to consider when introducing and using surveillance devices. It includes practical considerations and tips for planning and preparing for the implementation of, and ongoing use of, surveillance devices.
