New Derivatives topic launched by Practical Law Banking and Finance
The new Derivatives topic provides a suite of practical resources that will be invaluable to finance lawyers involved in drafting and negotiating OTC derivatives documented under standardised ISDA® documentation, as well as navigating the rules relevant to the regulation of OTC derivatives in Australia.
Some of the new resources include:
- Practice note: overview, Understanding the ISDA Master Agreement and Schedule, which provides section-by-section commentary on the 1992 and 2002 ISDA® Master Agreements.
- A number of resources dealing with the complexities of designating the early termination of derivative transactions following the occurrence of an event of default or termination event under an ISDA Master Agreement. These resources include a detailed practice note (Practice note, ISDA® Master Agreement: early termination) and checklists, together with standard form notices which can be used to effect an early termination.
- Practice notes on the regulation of OTC derivatives in Australia including the margin rules for uncleared derivatives (Practice note, Australian derivative regulation: margin and risk migration requirements for uncleared derivatives) and the derivative transaction and position reporting rules (Practice note, Derivative transaction and position reporting in Australia).
