New and refreshed resources to help you draft and negotiate a commercial lease

As part of the ongoing maintenance of our resources, we have recently completed a comprehensive review of Standard document, Commercial lease: part of building, to update and expand the clauses in the lease as well as to add comprehensive drafting and negotiation guidance throughout.
We have also published a suite of new resources to supplement the refreshed commercial lease, including:
- Practice note, Application of the unfair contract terms regime to property transactions. This note considers the application of the unfair contract terms regime under the Australian Consumer Law to the sale of land and retail and commercial leasing. This note is especially topical and important for those who are preparing for the commencement of the reforms to the unfair contract terms regime in November 2023 and considering the implications on their (or their clients’) businesses and processes.
- Toolkit, Drafting and negotiating a commercial lease, which pulls together all of Practical Law's resources for a landlord and tenant who are drafting and negotiating the terms of a commercial lease. The toolkit includes links to 30 new standard clauses that are additional or alternative clauses for inclusion in a commercial lease. This includes clauses relating to assignments and subleasing, cleaning, disputes resolution, landlord rights and obligations, rent and outgoings and tenant’s works (among other things), as well as tenant- or landlord-friendly and jurisdiction-specific clauses.
