What are the Statutes Case Annotations?

The Statutes Case Annotations is a collection of case summaries which are linked to the legislative provision that each case interprets.

 Where can I find them?

The Statutes Case Annotations is a feature of the product Australian Bankruptcy Law & Practice. Each case annotation interprets provisions of the Bankruptcy Act 1966, Bankruptcy Regulations 1996 or both. The annotations are accessible either online or hardcopy.

 How many and how old are the cases?

Over 1,000 cases have been summarised by Legal Editors from Thomson Reuters. The cases reported are from 1968 to current and new cases are added at least twice a year.

 That's a lot of cases - are the Statutes Case Annotations easy to read?

In Australian Bankruptcy Law & Practice, the case annotations are organised according to provisions of the Bankruptcy Act 1966 or Bankruptcy Regulations 1996. To improve the annotations even further, the following enhancements have been recently added (for looseleaf subscribers, the enhancements will be contained in Update 160 - April 2013 of Australian Bankruptcy Law & Practice):

  • paragraph numbering: each case annotation now contains an individual paragraph number for ease of navigation;
  • a "Table of Cases Reported" (looseleaf only): this Table has been inserted at the front of the Chapter to assist subscribers in locating annotations by case name. Online subscribers can locate specific cases in the search field of Westlaw AU;
  • internal cross-references: where case annotations reference more than one legislative provision, a cross-reference to other relevant paragraphs within the Chapter has been inserted at the end of the annotation; and
  • linking to other case summaries within Australian Bankruptcy Law & Practice: the cross-references also include links to the case summaries found in the Digest of Judgments, which are written and updated by the current authors Paul McQuade and Michael Gronow. The Digest of Judgments will also be enhanced later in 2013 to include references to the Statutes Case Annotations.
